Privacy Policy

GMH Legal understands the importance of privacy and is committed to complying with the Privacy Act 1988 (Cth) (Privacy Act) and the National Privacy Principles (NPP) which set out how private sector organisations must handle and treat “personal information” and “sensitive information”

“Personal information” means information or opinions about an individual whose identity can be apparent or can reasonably be ascertained
from the information.

“Sensitive information” means personal information or an opinion about your racial or ethic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a trade union, sexual preferences or practices, criminal record. It also includes your health information or genetic information.

This Privacy Policy covers personal information we handle about clients, service providers, visitors to our website and employment applicants.

 

 

 

What personal information does GMH Legal collect and how?

In all cases, GMH Legal will only collect personal information by lawful and fair means and not in an unreasonably intrusive way.
When you provide GMH Legal with instructions we may collect personal information about you, such as your contact details and financial information. We may also collect sensitive information about you GMH Legal will only collect personal information if it is necessary for GMH Legal to provide legal services to you. If not already apparent at or before the time we obtain your personal information, we will endeavour to tell you why we are collecting your personal information and how we intend to use it.
Sensitive information will only be collected by GMH Legal with your consent or if authorised by law.
In order to provide you with legal advice GMH Legal may collect personal information about you from third parties eg. people you work with, from public records and service providers.
If GMH Legal collects personal information about you from a third party, we will take reasonable steps to ensure that you are aware of the identity of the third party, their contact details, the purposes for which the information is collected, your ability to access the information, the law that compels the collection of the information and the main consequences to you if all or part of the information is not provided.
Service Provider
If you are a business service provider to GMH Legal, personal information about you including your name, company title and contact details may be collected.
Employment Applicant
If you are making an application for employment, GMH Legal will collect personal information from you and may collect further personal information from referees and past employers set out in your resume and/or employment application. With your consent or if authorised by law GMH Legal may in some situations also collect further information about you which could include a record check with the NSW Police.

How GMH Legal may use and disclose your personal information

Unless you provide GMH Legal with your consent, GMH Legal will only use the personal information collected for the primary and related purposes that GMH Legal disclose at the time the information is collected (for example, for the provision of legal advice or to appraise your employment application) and as set out in this privacy policy.
GMH Legal may also use your personal information, such as your name and contact details, to keep you informed of legal developments, for direct marketing and to invite you to GMH Legal events and functions. If you do not wish to receive such information you may make a request to GMH Legal using the contact details at point 9 of this Privacy Policy, and we will abide by this request.

When GMH Legal may disclose your personal information

As a client of GMH Legal, GMH Legal may disclose your personal information to third parties to provide the services you have instructed GMH Legal to provide. The third parties that GMH Legal may disclose your personal information include, but are not limited to, barristers and experts (eg. accountant, science, medical), Courts or Tribunals and regulators.
GMH Legal may also disclose personal information about you to service providers that assist GMH Legal in operating its general business.
Where required or permitted by law, GMH Legal may disclose personal information about you to other third parties.

GMH Legal will consider your request for access and within a reasonable time notify you if and/or when access can be granted.

GMH Legal will ordinarily not charge for the cost of providing access to your personal information.

If GMH Legal is required to decline your request for access we will provide you with reasons for our decision.

If you seek to amend personal information that GMH Legal hold you may contact us and we will correct any personal information that we agree is incorrect, incomplete or not current. If we do not agree with your requested amendments we will provide you with reasons for our decision.

Transfer of personal information outside Australia

As a client we may, with your consent or where necessary for the performance of our legal services to you, transfer your personal information overseas; for example, to an overseas legal agent.

Website Browsing

The GMH Legal website may store cookies on your hard drive in order to enable you to view or use areas of the website. We may use cookies for purely statistical purposes. We do not store personal information.
